Employment Discrimination

Among the types of litigation that Mr. Nourmand handles is employment discrimination, which is prohibited under federal laws such as Title VII of the Civil Rights Act of 1964 and the Americans with Disabilities Act, as well as under California's Fair Employment and Housing Act (FEHA). In many cases, FEHA provides greater protections than federal law does. In most cases, FEHA applies to smaller employers, which are those with just five or more employees. There are several characteristics that are protected under FEHA, including race, sex, religious beliefs, ancestry, national origin, physical disability, mental disability, genetic information, medical condition, marital status, color, gender identity, gender expression, sexual orientation, age if you are over 40, military service, and veteran status.

Discrimination occurs when an employer makes an adverse employment decision based on a protected characteristic. It can include termination, failure to hire, demotion, failure to promote, or harassment.

Wage and Hour

Attorney Nourmand also handles wage and hour claims, including those that involve overtime and double time, meal breaks, rest breaks, misclassification of employees as exempt, nonexempt, or independent contractors, reimbursement for employment expenses, waiting time penalties, in-store commissions, non-discretionary bonus payment omissions, failures to compensate for off-the-clock work, and paycheck stub violations. All employers are supposed to follow federal and state wage and hour laws. For example, in California, nonexempt employees who work over five hours at a stretch are entitled to a 30-minute uninterrupted lunch break.

When a worker is misclassified as an independent contractor, the employer can avoid paying payroll taxes, withhold wages related to overtime, and avoid providing meal and rest breaks.
